The proposal of this work is to develop some aspects about the leasing institute and the civil liability as well as undertaking incursion in the diffilcult area of the compatibilization of the justinian codes (or institutes), aiming to find the convergence point, in the direction to fortify the thesis of that, in many cases, the lessors liability for actual damages caused to any third party, in opposition to the majoritary jurisprudence and doctrine. These thesis are not pacific, therefore, we will start approaching about the conceptual and doctrinal treatment given to the leasing contract, the nature as a mixing contract, more common forms, the object and the obligations of the parts. After that, one will search sketch the social solidarity idea that modified the legislative treatment and the doctrinal agreement of the civil liability in our legislation. We will se the contrary positions, through the bibliographical research, analysis and interpretation of the searched data, aiming the argument, the demonstration and the evidence of the defended hypothesis.
