Descripción

This chapter analyses how the regulation of family life in private international law is more and more often detached from territorial considerations. It argues that this process can be linked to three factors: the growing impact of human rights on private international law reasoning; an increased international mobility of internationals and some elements of legal pluralism. Taking surrogacy and divorce as illustrations, the chapter will go on to argue that more coherence is needed in the legal regulation of family relationships across borders and suggest ways forward.
