论国际技术贸易中的知识产权限制 - 古祖雪
【中文摘要】对知识产权实施合理的限制措施 ,用以防止权利人对知识产权的滥用 ,防止限制贸易和对国际技术转让造成不利影响的不合理做法 ,是国际技术贸易秩序的重要内容。本文根据国际法与国内法的最新进展 ,分析和讨论了国际技术贸易中的三种知识产权限制 :权利用尽原则、强制许可制度、许可合同中反竞争行为的禁止。
【英文摘要】It is an important part of the order of international trade in technology that laying reasonable limitation measures in order to prohibit right holders abusing their intellectual properties and the unfair practices of limiting trade and making harmful effects. In accordance with the newly development of international law and domestic law, this thesis discusses three limitations to intellectual property in international trade of technology in three aspects:right exhaust principle, compulsory license system and the ban of anti-competition activities in license contract .
